Terms of Service & Seller Agreement

These terms apply to everyone who uses gout509.com. GOUT 509 WHOLESALE is operated by GOUT 509 LLC ("GOUT 509", "we"). By creating an account, buying or selling, you agree to them.

1. What GOUT 509 WHOLESALE is

GOUT 509 WHOLESALE is an online wholesale marketplace that connects business buyers with independent verified vendors. We operate the website only. Each product is sold by its vendor, not by GOUT 509. Payments, vendor identity and bank verification, and vendor payouts are handled by our payment processor, Stripe. GOUT 509 never holds vendor funds and never has access to anyone's card or bank account details.

2. Accounts

Vendors need an account and must give true, complete information and keep their password private. Buyers do not need an account. We may review, approve, suspend or close any vendor account, and cancel any order, in case of fraud, false information, counterfeit goods or abuse.

3. Buyers

Buyers can browse and order without an account. Minimum order quantities (MOQ) and tier prices are set by each vendor. Each checkout includes products from one vendor. Vendors may be located in the United States, Canada, the United Kingdom, the European Economic Area or Switzerland; prices are shown and charged in the vendor's currency (for example USD, CAD, GBP or EUR), and the buyer's card issuer may apply its own exchange rate or foreign transaction fee. For orders shipped from another country, the buyer is responsible for any import duties, customs fees and taxes charged on delivery. Payment is made by card through Stripe, which collects the buyer's name, email, phone and shipping address and shares the shipping details with the vendor to fulfill the order. Buyers can track an order with the order number and checkout email. Buyers are responsible for their own sales-tax obligations; a resale certificate may be requested for tax-exempt purchases where required by law. Buyers must inspect deliveries promptly and report problems within 7 days of delivery.

4. Vendors — Seller Agreement

Verification. Vendors must complete Stripe verification (identity, tax information and bank account) and GOUT 509 review (business and inventory) before selling. Each product is reviewed before it goes live.

Commission. For each paid order, GOUT 509 receives a marketplace commission on the product subtotal: 10% during the vendor's first 3 months after approval, then 12%. Card processing (about 2.9% + $0.30 per order) is also deducted. Stripe takes these amounts automatically at payment and pays the rest directly to the vendor's own bank account. There are no sign-up, listing or monthly fees. We will announce any fee change at least 30 days in advance.

Fulfillment. Vendors must ship within their stated processing time, add a tracking number, describe products truthfully, use their own photos, keep stock accurate and honor their stated return policy.

Taxes. Vendors are responsible for their own income taxes. Stripe may issue Form 1099-K as required by law.

4b. Retail sellers, retail prices and returns

Products may have a retail price (from 1 unit) and a wholesale price that applies automatically when the buyer reaches the wholesale minimum quantity, across colors and sizes. Wholesale orders may ship free within the United States when the seller offers it. Individuals may register as retail sellers with a simplified account; retail sellers may sell brand-new items only, and GOUT 509 reviews each account and product and may withdraw retail-selling authorization at any time. Stripe verifies the identity and bank account of every seller. Retail purchases may be returned within 30 days of shipping for any reason, including if the buyer does not like the item (the item must be unused and in its original condition). Wholesale purchases are final sale: a return or refund is only possible if the item arrived damaged or is the wrong item, reported within 7 days of shipping. Buyers request returns on the Returns page with their order number and checkout email; the seller approves or rejects the request and gives return instructions, and approved refunds are issued to the buyer’s card through Stripe and deducted from the seller’s sale. Retail purchases may be subject to sales tax.

4b-2. Local delivery

A seller in the United States may mark a product “Local delivery only” with a delivery area. The buyer must be inside that area; the seller delivers the order in person or by local courier.

4c. Listing-only countries (Haiti, Dominican Republic)

In countries where online payment to sellers is not available (currently Haiti and the Dominican Republic), sellers pay GOUT 509 a monthly listing fee by credit or debit card through Stripe (renewed automatically each month until cancelled) to show their products with their own price and contact details. Buyers contact the seller by phone or WhatsApp. These sellers deliver locally, inside their own country only. The price, payment, delivery and any dispute are solely between the buyer and the seller. GOUT 509 is not a party to these sales, does not receive or hold any payment for them, cannot issue refunds for them and is not responsible for fraud, non-delivery, product quality or any loss arising from them. GOUT 509 may remove listings or accounts reported for fraud.

4d. Marketing and sales

GOUT 509 promotes the GOUT 509 WHOLESALE website as a whole. GOUT 509 does not advertise or market individual sellers or products and does not guarantee any number of views or sales. Each seller is solely responsible for promoting their own products (for example on social media, WhatsApp or with their own customers). GOUT 509 is not responsible if a seller’s products do not sell, and fees or commissions already paid are not refundable for that reason.

5. Prohibited items

Counterfeit, replica or "inspired" branded goods; stolen goods; weapons, ammunition and explosives; drugs, drug paraphernalia, tobacco, vape and CBD products; alcohol; prescription or unapproved medical products; hazardous materials; recalled products; adult content; live animals; and any item illegal to sell in the United States. Food, beauty, fragrance, children's products and electronics require extra review and may require licenses, safety certificates or proof of authenticity.

6. Returns, disputes and chargebacks

Each vendor sets its return policy, shown on the product page. If a buyer and vendor cannot resolve a problem, contact us and we will help mediate. If a buyer's bank reverses a payment (chargeback), Stripe may recover the amount and dispute fee from the vendor's balance; vendors should keep shipping and tracking records.

7. Liability

GOUT 509 is not the seller of the products and does not guarantee them. To the extent allowed by law, our total liability (GOUT 509 LLC) for any claim is limited to the commission we received on the order concerned.

8. Governing law and changes

These terms are governed by the laws of the State of Florida, United States. We may update them; the version shown here when you place an order or list a product applies.
